APPLICANT PRIVACY POLICY

Article 1 - Definitions

Worksmart Company B.V. respects the privacy of its applicants, in particular the rights of applicants with regard to the automated processing of personal data. Because of full transparency towards our job applicants, we have therefore formulated and implemented a policy regarding this processing itself, its purpose as well as the possibilities for job applicants to best exercise their the rights. for all additional information on the protection of personal data, please visit the website of the Personal Data Authority.
1. A personal data is any information about an identified or identifiable natural person. For you, this means that the information is directly about you or can be traced back to you. This could be your name, date of birth or address, but also your (business) e-mail address or (business) telephone number is personal data. 
2. The General Data Processing Regulation further distinguishes between ordinary and special personal data. Special personal data are data that by their nature are extra sensitive and whose processing is prohibited, unless a specific exception applies or explicit consent has been given. They specifically include data on racial or ethnic origin, political opinions, religion or belief, trade union membership, genetic or biometric data for the purpose of unique identification, health, sexual life or criminal record. 
3. Processing personal data concerns all acts that Worksmart Company B.V. may perform with your personal data. Actions that this includes in any case are: collecting, recording, organising, storing, updating, modifying, retrieving, consulting, using, transmitting, distributing, making available, bringing together, linking, blocking, erasing and destroying personal data.

Article 2 - Accountability

Worksmart Company B.V. processes personal data of job applicants and other persons who respond to vacancies or express an interest in performing work for Worksmart Company B.V. Worksmart Company B.V. processes such personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation. In this privacy statement, Worksmart Company B.V. informs you how Worksmart Company B.V. processes your personal data and what rights you have in that regard. For clients and other persons with whom Worksmart Company B.V. maintains contact in connection with or as an extension of its services, Worksmart Company B.V. has its own privacy statement (see PRIVACY STATEMENT on the website).

Article 4 - Purposes of processing

As a job applicant, you provide your personal data to Worksmart Company B.V. or to a person associated with Worksmart Company B.V. by post, e-mail or by handing over or providing documents or records. Worksmart Company B.V. may also receive your personal data through third parties or websites, such as name and address details, training details or contact details. Worksmart Company B.V. processes the personal data obtained only for the purposes set out below. Worksmart Company B.V. will contact you prior to processing your personal data for other purposes to give you the opportunity to object to further processing. Worksmart Company B.V. may process this and other personal data provided for the following purposes:
  • establishing and maintaining contact

Article 5 - Legal grounds for processing 

The processing operations for the aforementioned purposes each have at least 1 legal basis. These legal grounds are as follows.
1. Consent: the free, explicit and unambiguous consent to process given by you. If Worksmart Company B.V. processes personal data on the basis of this consent, you always have the right to withdraw this consent. If processing takes place solely on the basis of the consent you have given, no further processing may take place after you have withdrawn your consent. Withdrawal of consent does not affect the lawfulness of processing based on the consent prior to its withdrawal.
2. Precontractual measures: taking measures at your request prior to the conclusion of a contract for the purpose of being able to conclude this contract, such as the preparation of an employment contract.
3. or from a third party, such as when Worksmart Company B.V. wishes to demonstrate that Worksmart Company B.V. has designed the job application process in a fair and honest manner, without discrimination. If Worksmart Company B.V. processes personal data (in part) on the basis of a balancing of interests, Worksmart Company B.V. will state the legitimate interests and inform you accordingly.

Article 6 - Personal data of job applicants

Worksmart Company B.V. may process the following data about you as an applicant for employment.

  • your name, first names, initials, any title, gender, photograph, date of birth, address, postal code, place of residence, telephone number and other information we need to communicate with you, such as your e-mail addres
  • other data with a view to fulfilling the position, which have been provided by you or which are known to you
  • data concerning the nature and content of previous jobs, and information about their termination
  • data concerning the nature and content of your current job, and data on the termination thereof
  • data concerning the position for which you are applying
  • details of education, courses and internships you have attended and will attend
1. Worksmart Company B.V. will inform you in advance of cases in which you are obliged to provide personal data that must then be processed by Worksmart Company B.V. on the basis of a legal or contractual obligation and/or necessary condition to conclude an agreement. In such cases, you will also be informed of the consequences associated with your possible refusal to provide this personal data.
2. Worksmart Company B.V. already makes clear in the vacancy text which personal data is minimally necessary for you to be admitted to the application procedure. If you do not provide these personal data (in full), you cannot be admitted to the procedure. Additional personal data may be requested at any stage of the application procedure. It will be explained what the consequence is if these personal data are not provided. If Worksmart Company B.V. ultimately decides to enter into an employment agreement with you, you will also be required to provide certain personal information in order to enter into the agreement

Article 8 - Retention periods

1. If you request general information and / or ask questions, Worksmart Company B.V. stores your personal data that you provide to it as long as there is contact on the same subject. After four weeks of no further contact, we will delete your personal data within the following four weeks.
2. If you apply or show interest in a job opening or performing work for Worksmart Company B.V., Worksmart Company B.V. will retain your personal data as long as the application process is ongoing and/or mutual interest is shown in possibly entering into an employment contract. Your personal data will be deleted within four weeks of the end of the application process or when no further contact has taken place for four weeks. An exception applies if you give us permission to keep your personal data for a longer period of time. In that case, your personal data will be kept for up to one year after consent.
3. In the event of a complaint or dispute about the contact or application procedure, your personal data will be kept for the duration of the handling of this complaint or dispute. When it has been established that a complaint or dispute has been resolved or ended, the personal data kept for this purpose will be deleted.

Article 9 - Provision and transfer of personal data

Worksmart Company B.V. does not provide your personal data to other parties. There is no transfer of personal data to third countries or international organizations, nor does automated decision making and/or profiling take place.

Article 10 - Security of personal data

Worksmart Company B.V. has taken appropriate technical and organizational measures to prevent the loss or theft of personal data or unlawful processing. Personal data that you enter on the contact or application form on Worksmart Company B.V.’s website is sent via a secure connection.

Article 11 - Your rights as an applicant

Under the AVG, you have the following individual rights as a job applicant with respect to the processing of your personal data.

Article 12 - Exercise of your rights, exceptions and procedure

Worksmart Company B.V. does not have to respond in all cases to an appeal to one of the rights listed in Article 11. Within one month after Worksmart Company B.V. receives your appeal to one of the aforementioned rights, Worksmart Company B.V. will contact you. In doing so, Worksmart Company B.V. will inform you whether your request is acted upon or whether the one-month review and response period should be extended. Exercising these rights is free of charge for you. You can exercise these rights by submitting a request using the contact details provided in this statement.

Article 13 - Complaint procedure

Should you, despite Worksmart Company B.V.’s careful approach to the processing and protection of personal data, have a complaint about it, you have the right under the AVG to file a complaint with the Personal Data Authority. See the website: www.autoriteitpersoonsgegevens.nl.

Article 14 - Modification of the privacy statement

This privacy statement is effective as of March 14, 2022 and may be amended by Worksmart Company B.V.. The amended privacy statement will be published on this website. That there is an amendment will be clearly communicated.

Article 15 - Applicable law

These terms and conditions are governed by Dutch law. The court in Worksmart Company B.V.’s place of business has exclusive jurisdiction over any disputes relating to this privacy statement, except where a statutory exception applies.
